These Terms of Service govern the contractual relationships between KARL DUPONCHEL and clients for all web development, design, and consulting services.
Services offered include:
All projects are subject to a detailed free quote. The quote is valid for 30 days from its issue date.
The order is considered firm and final after the client signs the quote and pays any deposit.
Pricing: Prices are expressed in euros, excluding taxes. Applicable VAT is that in effect on the invoice date [if VAT applicable].
Payment terms:
In case of late payment, penalties of 10% of the total amount including tax will apply, as well as a flat-rate compensation for recovery costs of €40.
Delivery times are indicated for information purposes in the quote. They may be modified in case of client modification requests or force majeure.
Intellectual property rights to the creations are transferred to the client only after full payment of the project.
The service provider reserves the right to use the creations for promotional purposes (portfolio, social media) unless the client requests otherwise in writing.
The service provider undertakes to perform services in accordance with professional standards and agreed specifications.
A warranty period of 1 month is granted to correct any bugs or malfunctions reported by the client.
The service provider shall not be held liable for indirect damages resulting from the use or inability to use the services provided.
Any modification to the initial specifications will be subject to an amendment to the quote and may result in a revision of prices and deadlines.
In case of project cancellation by the client, the deposit paid remains acquired by the service provider. Services already performed must be paid pro rata.
The service provider undertakes to respect the confidentiality of information communicated by the client in the context of the service.
In case of dispute, the parties undertake to seek an amicable solution before any legal action.
Failing agreement, the dispute will be submitted to the competent courts of Rouen (France).
In accordance with article L. 612-1 of the French Consumer Code, the client may resort free of charge to a consumer mediator in case of dispute.
